Orders placed on Homiaro.com are concluded with the owner named above, who acts as the seller.

2. Scope

These conditions govern the sale of products through the Website to consumers. By confirming an order the customer declares that they are of legal age and accept these conditions as published at that moment.

3. Orders and prices

• There is no minimum order amount.
• All prices are shown in euros (€) and include the applicable Spanish VAT. The total amount is shown before you confirm the payment.
• The order is deemed accepted when the customer receives the confirmation email.
• If an obvious error in the price or description is detected before dispatch, we will inform the customer, who may confirm the order at the correct price or cancel it for a full refund.
• Availability is stated on each product page. If a product becomes unavailable after purchase, we will offer an alternative or a refund.
• Some products are made for a specific market (for example the United Kingdom) or for a specific gas type; the product page states this. Check compatibility with your installation before you buy.

4. Payment methods

We accept Visa, Mastercard and American Express. Payment is made online before dispatch through a secure PCI DSS certified gateway; your bank may request 3-D Secure verification. We do not store your full card details. If the payment is not completed, the order is cancelled automatically.

5. Shipping

We ship to the whole of Spain (mainland, Balearics, Canary Islands, Ceuta and Melilla), to the European Union countries and to the United Kingdom. Shipping is free, with no minimum order. Estimated times from order confirmation: 2–7 business days within Spain (whole territory) and 6–8 business days for the European Union and the United Kingdom.

6. Delivery and incidents

• Delivery is made to the street address provided by the customer.
• When you receive bulky or fragile items (for example toilets, ceramic or stone basins and water heaters), check the package before signing for it; if you cannot, sign it as “unchecked” and keep the packaging until you have checked the product.
• If the packaging arrives damaged, note it on the carrier’s delivery document and tell us within 7 calendar days, attaching photographs.
• Delays caused by the carrier, by customs or by force majeure do not give rise to compensation, without prejudice to consumer rights where delivery does not take place within a reasonable period.

7. Withdrawal, returns and exchanges

• The customer has 30 calendar days from receipt to return an order, which is longer than the statutory 14-day right of withdrawal.
• The return is free when the product is faulty, arrives damaged or does not match the order.
• Within Spain voluntary returns are free; for the European Union €24.90 is deducted and for the United Kingdom £34.90.
• The refund is issued to the original payment method within 14 calendar days of receiving the return.

8. Legal guarantee

New products are covered by the 3-year legal guarantee of conformity under Royal Legislative Decree 1/2007, as amended by Royal Decree-Law 7/2021. Depending on the circumstances, a claim may be resolved by repair, replacement, price reduction or termination of the contract. The manufacturer’s commercial warranty, where it exists, applies in addition to and never instead of the legal guarantee.

9. Consumer rights

These conditions do not limit the rights granted to consumers by Spanish and European consumer law. Any clause contrary to those rules shall be deemed not to have been written.

10. Intellectual property and liability

The content of the Website is protected by intellectual property law. The trade marks, trade names and logos of the manufacturers shown on the Website belong to their respective owners and are used for identification purposes only. Homiaro is an independent retailer and is neither affiliated with nor endorsed by the manufacturers.

11. Applicable law and jurisdiction

These conditions are governed by Spanish law. Disputes shall be settled by the Courts and Tribunals of Madrid, unless mandatory consumer-protection rules give jurisdiction to the courts of the consumer’s place of residence.

12. Changes to these conditions

The seller may change these conditions at any time. Each order is governed by the conditions in force when it is confirmed.
